TO: Mr. Deputy District Attorney of the Republic

Re: Our suit No. 99-36 vs:
- Monsieur Pierre Cotiche, Chief Gendarme de Atuona, Hiva Oa and
- D.R.C.L. Direction de la Réglementation et du Contrôle de la Légalité

Monsieur le Procureur,

We have received a letter, dated Febraury 9, 1999, from M. Jeanjean, General Secretary of the High Commissioner of the Republic in French Polynesia, concerning our request for a residency permit of January 27, 1999.

It seems that the D.R.C.L. acts against European laws and the court decision of the Tribunal Administratif of Papeete of October 26, 1993, in the case of visas, the bond payment and the residency permit for European citizens.

Please find enclosed a copy of the letter from Mr. Jeanjean, dated February 9, 1999. In addition, we would like to bring to your attention several facts to which we refer in our letter of response, dated February 24, 1999.

We would like to know if, according to the Tribunal Administratif de Papeete, the behavior of the D.R.C.L. as described in the letter of February 9, 1999, is indeed in step with former court decisions of the Tribunal Administratif and with the international treaties linking France with the European Union.

We hope that the court decision of the Tribunal will specify the correct behavior for all EU citizens arriving in French Polynesia, especially concerning:

- The repatriement bond for European citizens,
- Visas for European citizens
- Residency permits for citizens.

Please note our new address for further correspondence:
